Government to set up panels to hear appeals against social media platforms

New Delhi: Grievance redress boards would soon be set up by the government to hear user appeals against content moderation decisions made by social media entities like Meta and Twitter.

In a notice to the Official Gazette published on Friday, the government amended the Information Technology Rules 2021 (Guidelines for Intermediaries and Digital Media Code of Ethics) to make it easier to set up such committees. grievances.

Under the new Information Technology Amendment Rules (Intermediary Guidelines and Digital Media Code of Ethics), 2022: “The central government shall, by notice, establish one or more grievance appeal boards within three months from the Information Technology Commencement Date (Intermediate Guidelines and Rules of Amendment to the Digital Media Code of Ethics, 2022.”

According to the Gazette notification: “Each Grievance Appeal Board shall consist of a Chairman and two full-time members appointed by the Central Government, one of whom shall be an ex-officio member and two shall be independent members.”

Under the new rules, any user aggrieved by a decision of an intermediary’s grievance officer can appeal to the government-appointed Grievance Appeals Committee (GAC) within 30 days.

GACs must resolve the issue within 30 days.

The committees will adopt an online dispute resolution mechanism to ensure that the entire process can be completed digitally.

The amended law requires intermediaries to upload a report after complying with each GAC order.
